Referral Program Terms and Conditions.

1.Definitions

1.1 Referred Client: someone who’s been referred to Amir & Danielle by an Original Client. You become a Referred Client by completing a contact form on an Original Client’s unique referral link and booking your Wedding photography with Amir & Danielle.

1.2 Only the person who books the wedding photography is considered the Referred Client, and there can only be one Referred Client for each Wedding Booked.

1.3 Wedding Booking: a new wedding photography service booked through the Original Client’s referral link.

1.4 Original Client: someone who meets all of the following conditions:

1.4.1 An existing or past client of Amir & Danielle who has paid in full their services fee.

1.4.2 Referrals made within one calendar of paying initial installment for photography services.

2. Eligible Referral:

A Referred client qualifies as an qualified referral if all of the following conditions are met:

2.1 The Referred client contacts Amir & Danielle through the Qualified User’s unique referral link.

2.2 The Referred client is not already an existing client of Amir & Danielle.

2.3 The Referred client was not referred to Amir & Danielle at an earlier date by someone else.

2.4 The Original client has made no more than 4 eligible referrals (maximum allowed referrals per client).

2.5 The Original client has paid in full either their 50% initial installment, second remaining 50% installment, or paid in full their services based on the discretion of Amir & Danielle.

2.6 The Referred Client must book and pay at a minimum their 50% installment for wedding photography services within 30 days of being referred by the Original Client.

3.eGift Card:

Refers to an electronically purchased and transferred gift card purchased by Amir & Danielle as a means of rewarding existing and new clients. Amir & Danielle will not be held liable for any lost, stolen, or misused eGift cards by clients. eGift cards must be selected from giftcards.ca.

3.1 The eGift card will be purchased using Canadian currency only, and will only hold Canadian funds.

3.2 Amir & Danielle will not be held liable for any lost, stolen, or misused eGift cards by clients.

3.3 Amir & Danielle will not be held liable for the negligence of any or all of the following: eGift Card issuer(s), merchant(s), Vendor(s) or any external parties involved in generating/transferring/managing the eGift cards.  

3.4 Amir & Danielle will email the gift cards using the email provided by the clients. This email will be the email of correspondence used when contacting Amir & Danielle for photography services.  

3.5 The terms and conditions for each eGift card will be managed by the distributor. Amir & Danielle are not responsible for communicating the terms and conditions of any eGift cards, and will not be held liable for any lost funds due to the distributor's negligence.

3.6 It is the Original and/or Referred clients duty to understand or research the nature of the eGift card that they select. Some eGift cards may only be redeemable online, or in-store, or both. Amir & Danielle are not responsible for communicating the terms and conditions of any eGift cards to clients, and will not be held liable for any lost funds or time if the client cannot redeem the eGift card using their method of choice.

4. Program Overview

4.1 Amir & Danielle Reserve all rights in the issuance of rewards with respect to the Amir & Danielle Circle - Preferred Client Referral Program, indefinitely.

4.2 To be an eligible participant in the Referral Program, you must meet either of the following conditions:

4.2.1 You’re an Original Client and the referral you made is deemed an Eligible Referral by Amir & Danielle.

4.2.2 You’re a Referred Client and your Referred Booking is deemed an Eligible Referral by Amir & Danielle.

4.3  If you meet the eligibility criteria, you and your referred client will receive an eGift card in accordance with the eGift card schedule.

4.4 You as the participant can refer up to a maximum of 4 clients limited to one calendar year using only your referral link.

4.5 The date of your referral program starts in accordance with the date signed on your original wedding contract. Example contract signed October 1, 2018. You will have until October 1, 2019, 11:59 PM eastern time to make referrals. Note Referrals are considered eligible when they book and pay their initial 50% deposit within the calendar year.   

4.6 If you receive a reward, you (as a Participant) are responsible for all applicable taxes and fees resulting from it. By participating in the Program, you release Amir & Danielle and their agents from all liability, including, without limitation, with respect to the Reward. Amir & Danielle reserve that right to suspend you as Participant from the Program at any time and reserves the right to cancel, modify or suspend the Program at any time without notice.

5. By taking part you agree to:

5.1  Comply with all applicable commercial and public laws.

5.2 To send referral links to people that you know and trust.

5.3 Not to engage in any activity that may be considered fraudulent or invasive or that may be considered spamming.

Amir & Danielle reserve the right to change these terms and conditions and the nature of the “Amir & Danielle Circle - Preferred Clientele Referal Program” at any time without notice.
